- Employer will only assist with locating shared rental housing upon arrival at the request of the employee. Employees are not required to live in housing the employer locates. Employees may make their own arrangements at their own expense. Deductions: all deductions required by law, cash advances, repayment of loans and overpayment of wages to the worker, payment for articles which the worker voluntarily purchased from employer, recovery of any loss to the employer due to the worker's damage (beyond normal wear and tear) or loss of equipment where it is shown that the worker is responsible, and any other reasonable deductions expressly authorized by the worker in writing. No deduction not required by law will be made that brings the workers hourly earnings below the FLSA Federal statutory minimum wage.

Work description
FHT, LLC dba Tilley Landscape ("Tilley Landscape" or "the Company") respectfully requests certification for six (6) temporary H-2B landscape laborers for the period October through February. Our need is temporary and peakload in nature. We maintain a core permanent workforce, but each year our workload changes materially in the fall and winter as ordinary growing-season landscaping transitions into contract-driven leaf removal, fall clean-up, winter property preparation, and snow and ice response services. The requested workers are needed only to supplement our permanent employees during this short, recurring fall/winter peak and will not become part of our regular year-round workforce. The requested period is supported by objective business records. We are submitting a 2025 payroll summary, copies of invoices for work actually performed, copies of customer contracts, and a representative annual service contract showing the month-by-month sequence of services. The representative contract specifically shows that leaf removal and fall services begin in October, while our snow contracts document snow and ice removal obligations that continue through the winter and into February. Company Operations and Recurring Annual Work Cycle Established in 2022, Tilley Landscape provides professional commercial and residential landscaping and exterior property-maintenance services in the Virginia Beach/Hampton Roads area. Our work is performed outdoors and is highly influenced by the seasonal cycle, customer service calendars, leaf fall, storm events, and winter weather. Beginning in October, customer obligations shift toward leaf collection and removal, fall clean-up, bed and landscape preparation, final trimming and maintenance, debris removal, and winterization. As fall progresses, leaf-removal frequency increases and must be completed on customer schedules. During the winter portion of the requested period, our service obligations shift again to snow and ice response under customer contracts, together with limited winter landscape and property-maintenance work as conditions permit. Fall/Winter Schedule of Operations Period Primary Work Why Additional Labor Is Needed October Leaf removal; fall clean-up; final mowing/trimming; bed preparation; debris removal Fall-service calendars begin and customers require recurring leaf and clean-up visits while regular landscape obligations are still winding down. November High-volume leaf removal; property clean-up; winter preparation Leaf accumulation and scheduled clean-ups require labor-intensive collection, loading, hauling, and disposal within narrow service windows. December Late leaf/fall services; winter property maintenance; snow/ice readiness and response Fall work continues while winter contracts become operational, requiring a workforce available for weather-triggered response. January Snow and ice response; winter storm clean-up; limited landscape/property maintenance Customer snow contracts require timely mobilization when events occur. The need is event-driven, time-sensitive, and temporary. Through February 1 Snow/ice response; post-event clean-up; completion of winter contract obligations The additional workforce is retained only through the defined winter service period, after which the positions end. Peakload Need We require the assistance of H-2B workers based on a peakload need. We regularly employ permanent workers to perform landscaping and property-maintenance services, but during the requested October-February period we must supplement that permanent staff to satisfy a short-term increase in labor demand. The temporary workers will not displace permanent workers and will not become part of our regular operation. We maintain a core permanent workforce that continues to perform our regular operations. The H-2B workers are requested only as supplemental labor during a defined fall/winter workload peak. See attached temporary need statement.
