Deductions from Worker’s Pay: Article 6 of the NYS Labor Law, sections 193.1 and 193.2, prohibit an employer from deducting monies, either through payroll deduction or by separate transaction, any amount or charge which is not authorized by NYS labor law. Therefore, the employer may NOT make any other deductions NOT required by law.

Work description

Seasonal job working on a maple syrup and Christmas tree farm performing duties related to harvesting maple sap and Christmas trees. All tools and equipment necessary to the work will be provided by the farm owner. Workers will install, replace, maintain tubing system, tap maple trees, evaluate health of sugar maples for potential sap production and monitor sap flow level in tubing. Workers will use tools and equipment to gain access to new crops of trees, to facilitate the instillation of tubing systems in new production areas, pull taps at the end of the season and clean equipment. Workers will perform manual field work including not but not limited to planting, cultivating, harvesting/cutting and baling Christmas trees. Worker will select trees for cutting according to markings or size, species and grade and fells trees using axe or chain saw. Worker will take inventory and grade trees, prepare trees for digging by tying or wrapping as necessary. Lift, carry and load trees onto trucks for transport. Unload, move or load trees, nursery stock and/or supplies. The worker will prepare fields for planting by removing cull stock, debris, tree stumps, brush, ferns, vines and other growth from planting area using tractor, mattocks, brush hooks and/or axes. The worker will straighten, tie, prune and hand-shear tops and limb tips from Christmas trees to control growth, increase limb density and improve shape. Worker will remove weeds. This is outdoor work performed in part during harsh winter temperatures and conditions and includes extensive walking and frequent stooping. From October 20 - November 1, workers will harvest hemp. Workers will operate specialized harvesting equipment to cut and collect hemp crops. Workers will remove leaves, stems, and other unwanted parts of the hemp plant after harvesting. Workers will prepare the hemp by trimming, grinding, and cutting the plant material. Workers will be expected to travel back and forth between Lisbon and Red Hook for 1 month periods of times throughout the duration of the contract in order to split duties among the 2 locations. The locations in Red Hook and Lisbon are both owned and Dancing Rainbow Orchard, and there are times the need for workers may be greater at one location than the other. To which location a worker is sent will be at the full discretion of the employer. Both locations are Christmas tree, maple syrup, and industrial hemp farms. All travel expenses and traveling time will be paid work hours by the employer.
